Our reputation
for insightful research and our sensitivity to the needs of
government clients have attracted the interest of agencies
around the country from city governments to the
United States Department of Justice.
Jurors often
have strong opinions about the responsibilities and the conduct
of government agencies and officials. We
are experienced in dealing with the problems faced by public
agencies, as plaintiffs or defendants, and are adept at understanding
how people’s attitudes can influence the outcome of such
litigation.
Public expectations run the gamut from those who want to believe
the best of the government to those who expect the worst. Feelings
about the roles played by the government vary just as widely,
from those who want the government to be pro-active and strong
to those who fear government power and want to control it.
A sampling
of our cases:
Restraint of Trade
Thirty-six
state attorneys general and private class action attorneys
sued three major pharmaceutical corporations and doctors for
colluding to prevent consumers from purchasing products from
low cost outlets instead of from their doctors. We assisted
the trial team through mock trials and jury selection. At
the conclusion of the plaintiffs' case, the case settled very
favorably for the plaintiffs and the consumers they represented.
Construction
The county
government for a major metropolitan area was sued in a dispute
over responsibility for construction cost overruns on the largest
wastewater treatment plant in the state. Our focus group research
in this highly publicized case helped the County understand
the underlying concerns of its citizens.
Pension Funds
A lawsuit was brought by public entities against corporate executives
of a bankrupt company and a professional consulting firm claiming fraud and professional negligence resulting in the loss
of millions of dollars in pension funds. Our mock trial research on behalf of the public entities contributed to the
attorneys' success in negotiating a favorable outcome for their clients.
Airport Revenue
Airlines using LAX sued the City of Los Angeles claiming that the
City's increases in landing fees constituted a breach of contract. Though the case was eventually decided by a judge,
we helped the trial team assess the risks and benefits of a potential jury trial in this $100 million case.
