We know
well the dynamics that jurors wrestle with—both
the rush of some to presume the worst about a corporation or
a highly placed businessperson and the reluctance of others to
harshly judge the actions of people with heavy responsibilities
and great authority. Some of the ways jurors can respond to complexity
include:
- Giving up on learning the facts and basing decisions on
emotional reactions
- Setting aside the law in favor of simpler moral formulas
- Avoiding the push and pull of complicated and tense deliberations
by choosing to identify with the authority represented by the
prosecution.

High Publicity Cases
Intense
media attention has characterized many of the criminal cases
on which we have been retained. We have conducted surveys,
focus groups and trial simulations to help attorneys and courts
determine whether a change of venue was in order, or whether
special jury selection procedures were necessary. We design
juror questionnaires and develop approaches to voir dire that
elicit prospective jurors’ reactions
to pretrial publicity and identify prejudgment and bias.
Homicide
In homicide cases, we have worked with public defenders and
privately retained counsel. The courts have recognized our expertise,
appointing us to assist counsel in over 20 major cases.
Capital cases pose especially tough challenges. Jurors struggle
with strong emotional reactions and rely upon deeply held beliefs
to inform their decision-making. Jurors must:
- Deal with the impact of violent images and frightening events
- Reconcile the contradictions inherent in the guilt and penalty
phase defenses
- Balance
the pain of victims’ families with the pleas
to save the life of the defendant
- Understand
the defendant’s mental state.
